1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the website agiera.ai, associated platforms, newsletters, and services (collectively, the "Platform") operated by AGIERA PTY LTD (ABN pending), a company registered in New South Wales, Australia ("AGIERA", "we", "us", "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 16 years of age to use the Platform. By using the Platform, you represent that you meet this requirement. If you are under 18, you confirm that your parent or legal guardian has reviewed and consents to these Terms.

3. What AGIERA Does

AGIERA is an independent AI comparison and discovery platform. We provide editorial reviews, rankings, comparisons, educational content, and personalised recommendations for third-party AI tools and services.

Important: AGIERA does not develop, operate, or endorse any of the third-party AI tools reviewed on the Platform. Our reviews and rankings are editorially independent. No third party can pay for a ranking position or influence a review score.

4. Accounts and Registration

Certain features may require you to create an account. You agree to:

Provide accurate, current, and complete information during registration
Keep your login credentials secure and confidential
Notify us immediately at hello@agiera.ai if you suspect unauthorised access
Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

5.1 Free Tier

Access to reviews, comparisons, articles, and The AGIERA Brief newsletter is free.

5.2 AGIERA Pro

AGIERA Pro is a paid subscription service. Pricing, features, and billing frequency are displayed at the time of purchase. All prices are in Australian Dollars (AUD) unless otherwise stated.

5.3 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Payment is processed through our third-party payment provider (currently Stripe).

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused time within a billing period.

5.5 Refunds

Refund requests within 14 days of initial purchase will be considered on a case-by-case basis. Contact hello@agiera.ai.

5.6 Australian Consumer Law

Nothing in these Terms limits or excludes any consumer guarantees or rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). If our services fail to meet a consumer guarantee, you are entitled to the remedies set out in the Australian Consumer Law.

6. Intellectual Property

6.1 Our Content

All content on the Platform — including text, graphics, logos, icons, images, data, software, and the AGIERA brand — is owned by or licensed to AGIERA PTY LTD and is protected by Australian and international intellectual property laws.

6.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. You may not:

Copy, reproduce, modify, or create derivative works from our content
Distribute, sell, lease, or sublicense any part of the Platform
Use automated tools (scrapers, bots, crawlers) to extract data from the Platform without our written consent
Remove or alter any copyright, trademark, or proprietary notices

6.3 User Content

If you submit content (comments, reviews, feedback), you grant AGIERA a worldwide, royalty-free, perpetual licence to use, display, and distribute that content in connection with the Platform. You retain ownership of your original content.

7. Editorial Independence

AGIERA's reviews, rankings, and recommendations are produced by our editorial team and are not influenced by commercial relationships. Where we earn affiliate commissions from third-party tools, this is clearly disclosed and never affects our editorial judgments.

8. Third-Party Links and Services

The Platform contains links to third-party websites and services. AGIERA does not control and is not responsible for the content, privacy practices, or availability of third-party sites. Your use of third-party services is governed by their respective terms and policies.

9. Disclaimers

9.1 General Disclaimer

The Platform and all content are provided "as is" and "as available" without warranties of any kind, except as required by law (including the Australian Consumer Law). We do not warrant that:

The Platform will be uninterrupted, secure, or error-free
Content will be accurate, complete, or current at all times
Any specific result will be achieved by following our recommendations

9.2 Not Professional Advice

AGIERA content is for informational purposes only and does not constitute professional, financial, legal, or technical advice. You should evaluate any AI tool independently before making purchasing decisions.

10. Limitation of Liability

To the maximum extent permitted by law (and subject to your rights under the Australian Consumer Law), AGIERA's total aggregate liability to you for any claims arising from or related to these Terms or the Platform is limited to the amount you have paid to AGIERA in the 12 months preceding the claim, or AUD $100, whichever is greater.

AGIERA is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.

11. Indemnification

You agree to indemnify and hold harmless AGIERA, its directors, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, available at agiera.ai/privacy. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

13. Modifications

We may update these Terms from time to time. Material changes will be notified via the Platform or email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AGIERA regarding your use of the Platform.
